Registered users may participate in PriceDive's service. Registration is completely free, and users will not be charged for initializing an account or for processing. Non-registered guests must register in order to participate.

The right to use PriceDive's services is personal to individual users and may not be transferable to any other person or entity. Only 1 (one) user account per registered user is allowed. PriceDive, Inc. (hereby referred to as PriceDive) makes catching a great deal fun and safe. Once you read through and accept our terms of use, it'll be time to get started!

In order to preserve a safe and trusted experience for all users, PriceDive requires the following from its users (that's you!):

Users may use PriceDive for legal purposes only. It is not permitted for a user to engage in any conduct that in PriceDive's sole discretion restricts or inhibits any other user from using or enjoying PriceDive. Users may not use PriceDive to post or transmit any material that violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law. Nor may users post or transmit any material without PriceDive's express prior approval, that advertises for or any solicits any product or service.

PriceDive maintains rights to all copyrighted, trademarked, and proprietary material and information, including, but not limited to, text, graphics, software, and sound. Without PriceDive's express permission, users may not use any part of PriceDive's website contents, concept, look, brand, or any other proprietary material or information protected under copyright law.

Users may not infringe upon the copyright laws of any other entity when uploading, posting, or engaging in any activity on PriceDive's site. In the event that the user breaks copyright law, the user alone will be responsible and liable. Material or information a user submits to public areas of PriceDive (your username, for instance, but never your password) belong to the public domain. By agreeing to these terms, the user grants PriceDive the royalty-free, perpetual, irrevocable, non-exclusive right and license to reproduce the material or information in any way, including but not limited to copying, modifying, translating, and distributing.

By clicking "Submit your bid" or "Set Your Price!" you agree to purchase the selected item or items at the specified bid price.

PriceDive accepts payments with the following credit cards: American Express, MasterCard, Visa, Discover. PriceDive does not accept cash, check, money order, or any other payment that is not listed above.

Buyers are responsible for paying all taxes, include sales and customs taxes, and all additional taxes that might arise.

Orders not paid within 3 days of purchase will be cancelled.

You understand and agree that all items purchased through PriceDive are for delivery only, and further, that buyers may be responsible for paying shipping fees. Unless otherwise specified in the item description, orders usually ships 2 to 5 business days after payment has been received. PriceDive can not be held responsible for delays associated with delivery.

Instructions in the item description dictate the return policy of any particular item. For items for which we accept a return: Buyers are responsible for the shipping costs of each return, or are responsible for complying with alternative return terms if explicitly stated for that item at the time of purchase. All items being returned must be 100% complete and must be packaged in original packaging. All packing materials, blank warranty cards and other accessories and documentation must be included in the original packaging, as provided in the package you received. A return will not be processed, or a restocking fee may be charged in the event any item(s) included in the original shipment to you is not present in the returned package. Items sent for return consideration will be immediately denied and PriceDive's return policy will not be honored in the event that a return shipment is received by us improperly packaged, altered or physically damaged.

We treat the information you provide to us as confidential information. When we ask you for credit card data, it is transferred over a Secured Sockets Layer (SSL) line, provided you are using a SSL enabled browser such as Microsoft Internet Explorer or Firefox. We also use SSL on other pages where you would enter personally identifiable information. This ensures that your information is encrypted as it travels over the Internet. This secure mode is enabled before any such information is transmitted from your computer. You will know you are in secure mode when the padlock or key icon in the lower right-hand or left-hand corner of the computer screen appears in the locked position. In addition, when accessing a secure server, the first characters of the site address will change from "http" to "https". PriceDive does not and will not disclose your personal information to any third party.

PriceDive will communicate with you via email about the site and your transactions. For you safety, it is important you register with a valid email address. By changing your account preferences, you can opt-out of most messages and notifications. Some notifications such as, and not limited to, registration confirmations, dispute resolutions, can not be deactivated.

Any legal controversy or legal claim arising out of or relating to PriceDive terms of use or our services, excluding legal action taken by PriceDive Inc. to recover damages for, or obtain an injunction relating to, PriceDive.com site operations, intellectual property, and our services, shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in San Francisco, California and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or PriceDive Inc. may seek any interim or preliminary relief from a court of competent jurisdiction in San Francisco, California necessary to protect the rights or property of you or PriceDive Inc. pending the completion of arbitration. Should either party file an action contrary to this provision, the other party may recover attorney's fees and costs up to $1,000.00.
